Amy Huntley Photography’s Terms and Conditions
These are the official terms and conditions (‘Terms and Conditions’) of Amy Huntley Photography. These Terms and Conditions are legally binding and it is your responsibility to read the Terms and Conditions prior to your purchase.
For the avoidance of doubt by completing a full or part payment to Amy Huntley Photography you understand and agree to the Terms and Conditions.
It is AGREED that the following Terms and Conditions set out are the total agreement made between Amy Huntley Photography and you;
1.Definitions
‘Amy Huntley Photography’ = Amy Huntley who will be providing photography services. Further details are found in clause 2.
‘Fee’ = The sum agreed to be paid for the Shoot and Products supplied by Amy Huntley Photography prior to entering into the contract and these Terms and Conditions.
‘Notice’ = Written Notice of at least 48 hours prior to the Shoot.
‘Product(s)’ = The digital images supplied by Amy Huntley Photography after the Shoot.
‘Service’ = The Shoot and editing of the Products prior to being delivered to you.
‘Shoot’ = The photography shoot agreed to be performed by Amy Huntley Photography at the agreed time and location.
2. Amy Huntley Photography
Amy Huntley Photography is a small photography business based in Berkshire.
Amy Huntley Photography can be contacted via AmyHuntleyPhotography@gmail.com.
3.Booking and Payment
Your Shoot is confirmed once you have paid the Fee and received a confirmation email.
The Fee must be paid via online transfer unless agreed otherwise.
The Fee is non-refundable or transferrable unless in accordance with clause 4.
Additional Products may be purchased after the Shoot and must be paid for prior to receiving the Products.
4.Cancellation
You have 14 days after booking the Shoot to cancel (Cooling Off Period) providing;
the Shoot has not already occurred; and
you provide Notice.
For the avoidance of doubt, you cannot cancel after the Shoot has occurred.
You are entitled to reschedule the Shoot once, providing you give at least 48 hours Notice.
If the Shoot is cancelled and a refund is required, Amy Huntley will endeavour to return the funds to you as soon as practical.
5.Limit of Liability
In the unlikely event that Amy Huntley Photography is injured, becomes too ill, or has an emergency/ event that prevents her from carrying out the Shoot, Amy Huntley Photography will make arrangements to re-schedule the Shoot.
If a suitable day for reschedule is not agreed, you agree that the responsibility and liability of Amy Huntley Photography to the you is limited to the return of all payments received for the Shoot.
In the unlikely event that digital files have been lost, stolen, or destroyed, including but not limited to camera, hard drive, or equipment malfunction, Amy Huntley Photography’s liability is limited to the return of all payments received for the Shoot.
Neither party should be liable for indirect or consequential loss.
6.The Shoot and Products
The location and time of the Shoot will be agreed with you in writing.
Within two weeks after the Shoot, you will receive an online gallery with images for you to review.
Amy Huntley Photography will provide you with no less than 10 images for you to review. The selection of images delivered to you are of Amy Huntley Photography’s discretion.
Amy Huntley Photography will then provide you with your chosen images via digital download within 7 business days of your confirmation.
All editing is completed to Amy Huntley Photography’s discretion but additional editing may be purchased at your request.
Original unedited images will not be available to purchase, as the developed Product reflects the desired aesthetics of Amy Huntley Photography and its brand consistency.
7.Re Shoots
In the unlikely event that the finished product from a Shoot is unusable due to technical problems, Amy Huntley Photography will reshoot at no additional charge. Alternatively, Amy Huntley Photography may offer a complete refund at her discretion.
8.Conduct in Shoots
You are responsible for the health and safety of your children during the Shoot. You must ensure that your children are with a responsible adult (other than Amy Huntley Photography) at all times during the Shoot.
If your child’s behaviour means Amy Huntley Photography is unable to perform the Shoot, the Shoot can be rescheduled but there may be an additional fee chargeable to to cover costs of Amy Huntley Photography attending the Shoot and re-shoot.
9.Adverse Weather
Amy Huntley Photography maintains the right to reschedule the Shoot due to bad weather. If Amy Huntley Photography determines that the weather is so bad that an outdoor session can’t take place, then the Shoot will be rescheduled at no extra cost to you. Amy Huntley Photography will endeavour to give as much notice as possible.
10.Model Release and Copyright
The 1998 Copyright, Designs, and Patents Act assigns copyright to and to remain the property of Amy Huntley Photography on all images. You are obtaining images for personal use only, and shall not sell prints or authorise any reproductions by parties.
All digital files and photographs remain the property and copyright of Amy Huntley Photography.
You grant Amy Huntley Photography permission (unless set out in writing to the contrary) to use the photographs from the Shoot for promotional purposes, including but not limited to her website, social media and marketing materials.
Amy Huntley Photography asks that any online distribution of her photos includes credit, this includes but is not limited to tagging Amy Huntley Photography on a social media post.
11.Storage of Images
Amy Huntley Photography will retain copies of the photos from the Shoot for at least 30 days. After this period, Amy Huntley Photography has no duty to retain copies of the images from the Shoot.
12.Privacy
Amy Huntley Photography will use and process your personal information in accordance with the Privacy Policy found on her website.
13.Entire Agreement
This agreement contains the entire agreement and understanding between the parties. Any variations must be agreed by both parties in writing.
The agreement is governed by the laws of England and Wales.
